Youth Media Use & Performance License

For Participants Under Age 18

To be completed by a parent or legal guardian

The Poet House documents programs, performances, workshops, events, and community gatherings through photography, video, and audio recording.

Permission for public media use is optional and is not required for a young person to participate or perform.

The Poet House may document programming for internal, archival, and operational purposes regardless of whether this form is completed. This agreement gives The Poet House permission to publicly use identifiable media of the young person named below as described in this agreement.

This is a standing media-use agreement. Once completed, it remains on file until the participant turns 18, the consent is revoked as described below, or The Poet House requests a new agreement.

YOUTH PARTICIPANT INFORMATION

PARENT / LEGAL GUARDIAN INFORMATION

1. MEDIA USE PERMISSION

I am the parent or legal guardian of the youth participant named above.

I give The Poet House permission to publicly use photographs, video recordings, audio recordings, and other media containing my child’s:

• stage name;

• image;

• likeness;

• voice;

• recorded performance;

• statements or interviews; and

• participation in Poet House programs and events.

This permission applies to eligible programs and activities operated by The Poet House, including Courageous Cadence and other youth programming.

2. AUTHORIZED USES

I authorize The Poet House to reproduce, edit, caption, excerpt, format, publish, display, distribute, transmit, broadcast, archive, promote, and otherwise use authorized media containing my child.

Authorized uses may include:

• The Poet House websites;

• social media;

• YouTube and other video or streaming platforms;

• promotional and marketing materials;

• event promotion;

• program recaps;

• newsletters and email communications;

• press and publicity;

• educational materials;

• grant applications and grant reporting;

• fundraising campaigns;

• organizational archives;

• exhibitions and presentations;

• membership content;

• ticketed or pay-per-view programming;

• digital products;

• advertising;

• monetized online content; and

• other uses reasonably related to The Poet House’s mission, programming, documentation, promotion, fundraising, or operations.

The Poet House may work with authorized photographers, videographers, editors, venues, fiscal or program partners, web hosts, social media platforms, streaming services, and other service providers as reasonably necessary to create, process, host, or distribute authorized media.

3. LICENSE TO RECORDED PERFORMANCE

The youth participant retains ownership of their original poetry, writing, music, and other underlying creative work.

For recordings created while this media-use permission is active, the parent or legal guardian authorizes The Poet House to use the youth participant’s performance as captured in the authorized recording.

This permission includes the right to reproduce, edit, excerpt, caption, format, publish, distribute, transmit, publicly display, publicly perform, archive, promote, and monetize the authorized recording.

Authorized uses may include:

• publishing a complete recorded performance;

• publishing excerpts or promotional clips;

• creating captioned, shortened, vertical, horizontal, or platform-specific versions;

• including the recording in program recaps, compilations, trailers, documentaries, promotional materials, or organizational archives;

• distributing the recording through The Poet House websites, social media, YouTube, streaming platforms, membership platforms, and other digital channels;

• including the recording in ticketed or pay-per-view digital programming; and

• using the recording in advertising-supported or otherwise monetized content.

The Poet House may authorize its contractors, editors, videographers, fiscal or program partners, venues, web hosts, social media platforms, streaming services, and other service providers to use the recording only as reasonably necessary to produce, host, distribute, promote, or make the authorized media available.

This agreement does not transfer ownership of the youth participant’s underlying poem, writing, music, or other original creative work to The Poet House.

The youth participant remains free to perform, publish, submit, license, sell, or otherwise use their underlying creative work independently.

This agreement does not authorize The Poet House to separately publish, sell, license, adapt, or otherwise commercially exploit the youth participant’s underlying creative work apart from the authorized recording without additional permission.

4. EDITING AND PRESENTATION

I understand that authorized media may be edited for length, clarity, accessibility, technical quality, or platform requirements.

Editing may include:

• trimming or excerpting footage;

• combining footage from multiple cameras;

• adjusting lighting, color, or audio;

• adding captions or subtitles;

• adding the participant’s name, title, graphics, or credits;

• resizing or reframing video;

• creating promotional clips; and

• incorporating footage into compilations or other authorized materials.

The Poet House will not intentionally edit a young person’s performance in a manner designed to materially misrepresent what they said or did.

5. MONETIZATION AND COMPENSATION

I understand that authorized recordings containing my child’s performance may appear in content that generates revenue for The Poet House.

Authorized monetized uses may include:

• advertising-supported YouTube or social media content;

• monetized streaming platforms;

• membership content;

• ticketed or pay-per-view digital programming;

• digital distribution of the authorized recording;

• promotional or fundraising campaigns;

• sponsored organizational content; and

• other revenue-generating uses of the authorized recording that are consistent with this agreement.

I understand that monetization of an authorized recording does not transfer ownership of my child’s underlying poem, writing, music, or other creative work to The Poet House.

Unless The Poet House and I enter into a separate written agreement providing otherwise, neither I nor my child is entitled to additional royalties, residuals, revenue sharing, or other compensation solely because an authorized recording is used or generates revenue.

This provision does not prevent The Poet House from separately compensating the youth participant for performances, commissions, employment, contracted services, licensing arrangements, or other work.

If The Poet House seeks to separately publish, sell, license, adapt, or otherwise commercially use the youth participant’s underlying creative work apart from the authorized recording, additional permission or a separate written agreement will be required.

6. OPTIONAL CONSENT

I understand that granting public media-use permission is not a condition of participation.

My child may participate in or perform at eligible Poet House programs even if I choose not to grant public media-use permission.

I understand that photography, video recording, or audio recording may still occur in shared program spaces for documentation, archival, operational, or production purposes.

If public media-use permission is not on file, The Poet House will not intentionally publish, promote, sell, monetize, or otherwise publicly feature identifiable individual performance media of my child under this agreement.

7. YOUTH ASSENT AND VOICE

The Poet House values young people’s agency in decisions about how they are represented.

In addition to my permission as parent or legal guardian, The Poet House will ask the youth participant to indicate whether they agree to the public use of their media.

If my child communicates to The Poet House that they do not want identifiable media of themselves publicly used, The Poet House will make reasonable efforts to honor that request even if I previously provided permission.

8. STANDING CONSENT

I understand that this is a standing media-use agreement.

I do not need to complete a new media release each time my child participates in an eligible Poet House program while this agreement remains active.

This agreement remains active until the earliest of:

• my written revocation of permission;

• the youth participant reaching age 18; or

• The Poet House requesting that a new agreement be completed.

When the participant turns 18, they must complete The Poet House’s adult Media Use & Performance License if they wish to continue allowing public media use.

9. REVOCATION

I may revoke permission for future recordings intended for public use and future new public uses by submitting written notice to:

Subject: Youth Media Consent Revocation

The request should include the youth participant’s name and the parent or guardian email associated with this agreement.

Revocation becomes effective after The Poet House receives and processes the request and applies prospectively only.

After revocation becomes effective, The Poet House will not intentionally initiate new public uses of identifiable media of my child under this agreement without obtaining new permission.

10. PREVIOUSLY PUBLISHED MEDIA

I understand that revocation does not apply retroactively.

To the extent permitted by law, revocation does not require The Poet House to remove, delete, recall, destroy, or discontinue media that, before the effective date of revocation, was already:

• published;

• posted;

• distributed;

• broadcast;

• streamed;

• sold;

• licensed;

• monetized; or

• incorporated into a completed or substantially completed work.

Previously authorized media may remain publicly available and may continue to be hosted, streamed, displayed, distributed as part of the existing publication or completed work, and monetized.

Revenue generated after revocation from a previously authorized existing publication does not, by itself, constitute a new media use requiring additional consent.

11. THIRD-PARTY MATERIAL

I understand that this agreement only grants rights that my child and I have the authority to grant.

If my child knowingly performs substantial copyrighted work owned by someone else, we agree to inform The Poet House when separate permission may be required.

12. NO GUARANTEE OF PUBLICATION OR FOOTAGE

I understand that granting media permission does not require The Poet House to:

• record my child;

• publish my child’s performance;

• feature my child in promotional materials;

• provide us with copies of footage; or

• retain any particular recording.

Availability of performance footage is not guaranteed.

13. ELECTRONIC AGREEMENT

I agree that electronically signing this form constitutes my electronic signature and agreement to these terms.

I understand that The Poet House may maintain an electronic record of this agreement, including participant information, parent or guardian information, acknowledgments, signatures, dates, and submission information.

14. PARENT / GUARDIAN AUTHORITY

I confirm that:

• I am the parent or legal guardian of the youth participant named above;

• the participant is under 18 years of age;

• I have authority to grant the permissions described in this agreement;

• I have read and understand this agreement; and

• I voluntarily grant the permissions selected below.

This section is for the young person participating in The Poet House program.

The Poet House wants you to have a voice in how photos, videos, and recordings of you are shared.

Your parent or guardian has given permission for The Poet House to use identifiable media of you. You can still tell us that you do not want your individual performance, photo, video, or audio publicly shared. Saying no will not prevent you from participating or performing.
